Terms and conditions for using AUSC Region 5 services

1. Agreement to Terms

By accessing or using the African Union Sports Council Region 5 (AUSC R5) website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Definitions

  • "AUSC R5", "we", "us", "our" refers to the African Union Sports Council Region 5
  • "User", "you", "your" refers to individuals accessing our services
  • "Services" refers to all products, services, and platforms provided by AUSC R5
  • "Member Countries" refers to the 10 Southern African nations within AUSC Region 5
  • "Content" refers to all information, data, text, images, and materials available through our services

3. Use of Services

3.1 Eligibility

You must be at least 18 years old or have parental/guardian consent to use our services. Athletes under 18 must have appropriate adult supervision and consent for participation in AUSC R5 programs.

3.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate, current, and complete information
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access
  • You may not transfer your account to another person without our consent

3.3 Acceptable Use

You agree not to:

  • Use the services for any unlawful purpose or in violation of these Terms
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the services or servers
  • Attempt to gain unauthorized access to any portion of the services
  • Upload or transmit viruses or malicious code
  • Collect or harvest personal information of other users
  • Engage in any activity that could damage AUSC R5's reputation

4. Sports Programs and Events

4.1 Registration and Participation

Participation in AUSC R5 sports programs and events is subject to eligibility requirements, registration procedures, and applicable rules and regulations. Athletes must comply with all competition rules, anti-doping policies, and codes of conduct.

4.2 Medical and Safety Requirements

Participants may be required to provide medical clearances, insurance documentation, and emergency contact information. AUSC R5 reserves the right to exclude participants who do not meet safety requirements or pose a risk to themselves or others.

5. Intellectual Property Rights

5.1 AUSC R5 Content

All content provided through our services, including text, graphics, logos, images, and software, is the property of AUSC R5 or its licensors and is protected by international copyright and intellectual property laws.

5.2 User Content

By submitting content to our services, you grant AUSC R5 a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, and distribute such content for the purposes of promoting sports development and AUSC R5 activities.

6. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in our Privacy Policy. We are committed to protecting your personal data in accordance with applicable data protection laws.

7. Disclaimers and Limitations of Liability

7.1 Service Availability

AUSC R5 services are provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation of our services.

7.2 Limitation of Liability

To the maximum extent permitted by law, AUSC R5 shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the services, including but not limited to personal injury, property damage, or lost profits.

8. Indemnification

You agree to indemnify and hold harmless AUSC R5, its member countries, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the services, violation of these Terms, or infringement of any third-party rights.

9. Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Botswana, where AUSC R5 headquarters is located, without regard to its conflict of law provisions.

9.2 Arbitration

Any disputes arising from these Terms or your use of AUSC R5 services shall be resolved through binding arbitration in accordance with the rules of the Southern African Development Community (SADC) Tribunal, unless otherwise agreed by the parties.

10. Modifications to Terms

AUSC R5 reserves the right to modify these Terms at any time. We will provide notice of material changes through our website or by email. Your continued use of the services after such modifications constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the services will cease immediately.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
